GENERAL CONDITIONS OF SALE
1. Seller Identification
These General Conditions of Sale are those of the company Bloom Paris, SAS with share capital of €1,500, whose registered office is located at 7 rue Nicolo, 75116 Paris, registered with the Paris Trade and Companies Register under number 852 679 356.
2. Scope of application
The purchase of products offered on Bloom-paris.fr is subject to these General Terms and Conditions of Sale. Orders placed on the Bloom-paris.fr website are reserved for end consumers, individuals, and businesses, other than for resale. Therefore, the customer confirms that they are acting as an end consumer and do not intend to resell Bloom Paris products for commercial purposes.
The General Terms and Conditions of Sale in effect at the time the contract is concluded are those that are binding on the customer. Bloom Paris may update these General Terms and Conditions of Sale at any time.
3. Order Terms
The Bloom-paris.fr website allows you to order a selection of Bloom Paris brand products from Bloom Paris immediately online via the internet for delivery in mainland France and internationally.
4. Availability
Product offers and prices are valid as long as they are visible on the Bloom-paris.fr website, while stocks last. Errors or changes may exceptionally occur, particularly in the case of simultaneous orders of the same product by several customers. In the event that a product becomes unavailable after the order has been placed by the customer, the customer will be informed by Bloom Paris via email or telephone as soon as possible. Bloom Paris will then offer the customer either to order another item presented on the Bloom-paris.fr website as a replacement, or to cancel the order. Bloom Paris assumes no liability in the event of out-of-stock or unavailability of products.
Bloom Paris reserves the right to change the items offered on the Bloom-paris.fr website at any time and without prior notice. In order to ensure better quality of service and availability of its products to all customers of the Bloom-paris.fr website, Bloom Paris reserves the right to limit the quantity of products that can be purchased by a customer in accordance with the applicable provisions in this area, in particular those of Article L122-1 of the French Consumer Code.
5. Order process
5.1. Product selection:
At any time, the customer can:
– add Bloom Paris products to your selection by clicking on “add to cart”,
– view selected Bloom Paris products by clicking on “view basket”,
– modify your selection by clicking on “update basket”, “delete” or by adjusting the quantities as appropriate.
For each product selected on the Bloom-paris.fr website, a summary page will automatically appear, including the item reference, description, color, photo, as well as the selected quantity, unit price, and total order price. Customers must carefully check the accuracy of their selection before confirming their order.
While every effort is made to ensure that the color and pattern of Bloom Paris products displayed on the Bloom-paris.fr website are faithful to the original products, variations may occur, particularly due to technical limitations of color rendering on computer equipment. Consequently, Bloom Paris cannot be held responsible for non-substantial errors or inaccuracies in the photographs or graphic representations of Bloom Paris products appearing on the Bloom-paris.fr website. 5.2. Customer account:
Once the products have been selected, the customer must click on "confirm order". Then, they will have to fill in the billing details and then click on "order".
The data recorded by the Bloom-paris.fr website constitutes proof of all transactions between Bloom Paris and its customers. In the event of a dispute between Bloom Paris and one of its customers regarding a transaction carried out on the Bloom-paris.fr website, the data recorded by Bloom Paris is considered irrefutable proof of the content of the transaction.
Any order placed online requires the customer to provide accurate and complete information at the time of ordering. The information requested will include: title, surname, first name, telephone number, email address, billing and delivery addresses.
6. Price – Payment
6.1. Price:
Bloom Paris product prices are listed in Euros, inclusive of all taxes. Except for the refund options provided below (see "Returns - Exchanges - Refunds"), Bloom Paris will not refund VAT on purchases made on the Bloom-paris.fr website (even if the buyer, after receipt, returns the Bloom Paris products to a country outside the European Union). The order amount includes delivery costs.
Bloom Paris reserves the right to modify the prices of products offered on the Bloom-paris.fr website at any time and without notice. Products are invoiced based on the prices displayed on the Bloom-paris.fr website at the time the order is placed, subject to the availability of the products ordered at that time.
6.2. Payment:
At the end of the ordering process, the customer is invited to click on the "Pay and complete your order" button. The customer is also asked to accept all of these General Terms and Conditions of Sale and Use and the Privacy Policy of the Bloom-paris.fr website by clicking on the button provided for this purpose. The sale will be final when the customer clicks on the "Pay and complete your order" button.
All orders placed on Bloom-paris.fr must be paid for immediately upon placing the order. Bloom Paris only accepts credit card payments. All orders are payable in euros. Accepted credit cards are MasterCard®, Visa®, and Maestro.
Payments are authenticated and secured using the 3D Secure system. This system is also known as "Verified by Visa®" or "MasterCard® SecureCode." During payment, the bank requests personal information from the customer to verify the cardholder's identity and validate the transaction.
How to pay with 3D Secure on Bloom-paris.fr?
After validating the customer's bank details (card number, expiration date and cryptogram), a new page will appear on which the customer will have to enter the personal information requested by their bank. This information can be:
– the answer to a personal question,
– a password that the customer has chosen in advance,
– a code sent by SMS,
– his date of birth…
Once the 3D Secure code has been entered and validated by the customer's bank, the order is finalized. The customer will then receive a confirmation email. Authentication is specific to each bank. For any questions regarding the 3D Secure code, Bloom Paris invites customers to contact their bank directly.
The order will only be shipped after verification of the payment method and receipt of authorization to debit the customer's card.
7. Order processing
Once completed, the customer's order is forwarded to Bloom Paris for processing. Bloom Paris reserves the right not to accept an order from a customer with whom it is in dispute over a previous order, or if Bloom Paris reasonably believes that the customer has violated these Terms and Conditions or engaged in fraudulent activity, or for any other legitimate reason.
An order summary will be emailed to the customer. The order confirmation will include a description of the selected Bloom Paris products, the quantity, the price, and the shipping costs. Bloom Paris advises its customers to keep this confirmation in paper or electronic form.
Pursuant to Article L134-2 of the French Consumer Code, when an order is for an amount equal to or greater than 120 Euros, Bloom Paris retains the written document certifying the contract concluded between Bloom Paris and a customer electronically for a period running from the conclusion of the contract until the date of delivery of the goods and for a period of ten years from this date (in accordance with Decree 2005-137 of February 16, 2005). The customer then has access to this document at any time, upon simple request made by email to Customer Service.
8. Retention of Title
The products ordered remain the property of Bloom Paris until full payment of the price by Bloom Paris. However, the customer assumes the risks (including loss, theft, or damage) concerning the delivered products from the moment they take possession of them upon delivery.
9. Delivery and collection area
Products purchased on the Bloom-paris.fr website can be delivered in France and internationally. For security reasons, Bloom Paris will not process any orders for which a poste restante, PO box, university residence address, or Cedex address is provided. Products are shipped to the delivery address(es) you provided during the ordering process.
10. Transportation costs
Shipping costs are calculated based on the amount and delivery area.
11. Delivery times
Delivery time is 3 to 5 working days in France and Europe, and up to 10 days in the rest of the world.
In the event of a return, the customer will be responsible for shipping the product at their own expense, in accordance with Bloom Paris's Customer Service department (bloomparis16@gmail.com). The product must be returned in perfect condition.
12. Delivery Problems
Any failure or delay in delivery exceeding eight (8) working days must be reported to Bloom Paris Customer Service as soon as possible. Any claim made more than thirty (30) calendar days after the date of validation of the order by the customer cannot be taken into account.
The customer must check the conformity of the goods at the time of delivery.
In the event of non-conformity of the products purchased or if they do not give satisfaction, the customer can return them or request an exchange or refund under the conditions provided in the section "Returns - Exchanges - Refunds".
13. Right of withdrawal
The customer has a legal right of withdrawal which he can exercise under the conditions provided for in articles L121-20, L121-20-1 and L121-20-2 of the consumer code, if he meets the conditions set out in these provisions, without having to justify reasons and without having to pay penalties:
As part of the exercise of the right of withdrawal, the customer can return the product(s) purchased by requesting an exchange or refund under the conditions provided in the section “Returns – Exchanges – Refunds”.
14. Returns – Exchanges – Refunds
In the event of product non-conformity or within the framework of their right of withdrawal, the customer may request the exchange or refund of the product under the following conditions. This request must be sent to Bloom Paris by email at bloomparis16@gmail.com
Returned products must be in their original condition and perfectly packaged, accompanied by their purchase invoice or a copy in the case of a partial return. The return of a product, in the event of an exchange or a refund request, is free of charge if this exchange or refund involves the responsibility of Bloom Paris.
Items must be returned after approval from Bloom Paris Customer Service. Bloom Paris will not be held responsible for loss, misdirection, or late delivery of a product that the customer wishes to return to Bloom-paris.fr, as the shipping risks are borne solely by the customer (the initiator of the shipment).
In case of exchange:
– if the amount of the product(s) chosen as a replacement has a value greater than the amount of the product(s) returned, the customer must pay the price difference in accordance with these General Conditions of Sale.
– if the amount of the product(s) chosen as a replacement has a value lower than the amount of the product(s) returned, the price difference will be refunded to the customer by Bloom Paris (it being recalled that for gifts, only the customer who purchased the gift can request a refund and have their bank account re-credited) in accordance with these General Conditions of Sale.
In case of exchange, the shipping costs of the first delivery are refunded, but the shipping costs of the second shipment are charged.
In the event of a refund request, this will be made in any event no later than thirty days after notification of the customer's right of withdrawal.
Under no circumstances will it be possible to assign the customer an electronic credit usable on the Bloom-paris.fr website.
Bloom Paris has full discretion to decide whether the products are in their original condition when returned to bloom-paris.fr.
15. Legal guarantee of conformity and hidden defects
The products sold on the Bloom-paris.fr website are subject to the legal guarantee conditions provided for by articles L211-4, L211-5 and L211-12 of the Consumer Code as well as by articles 1641 and 1648 of the Civil Code, of which here is a reminder:
Article 1641 of the Civil Code
"The seller is bound by the guarantee for hidden defects in the thing sold which make it unfit for the use for which it is intended, or which reduce this use so much that the buyer would not have acquired it, or would have paid a lower price for it, if he had known of them."
Article 1648 of the Civil Code
"The action resulting from latent defects must be brought by the purchaser within two years of the discovery of the defect. In the case provided for in Article 1642-1, the action must be brought, under penalty of foreclosure, within one year following the date on which the seller can be discharged from apparent defects."
Article L211-4 of the Consumer Code
"The seller is required to deliver goods that conform to the contract and is liable for any lack of conformity existing at the time of delivery. He is also liable for any lack of conformity resulting from the packaging, assembly instructions or installation when this has been made his responsibility by the contract or has been carried out under his responsibility."
Article L211-5 of the Consumer Code
“To comply with the contract, the property must:
1° Be suitable for the use usually expected of a similar good and, where applicable:
– correspond to the description given by the seller and possess the qualities that the latter presented to the buyer in the form of a sample or model,
– present the qualities that a buyer can legitimately expect in view of the public statements made by the seller, by the producer or by his representative, in particular in advertising or labeling;
2° Or present the characteristics defined by mutual agreement by the parties or be suitable for any special use sought by the buyer, brought to the attention of the seller and which the latter has accepted.
Article L211-12 of the Consumer Code
“The action resulting from the lack of conformity is prescribed after two years from the delivery of the goods”.
16. Limitation of liability
Under no circumstances can Bloom Paris be held liable for any indirect, incidental, special or consequential damages, including, but not limited to, loss of business, loss of profit or loss of opportunity resulting from the purchase of Bloom Paris products on the bloom-paris.fr website.
17. Applicable law – Disputes
These General Conditions of Sale are governed and interpreted in accordance with French law in accordance with EC Regulation 593/2008 of June 17, 2008.
The Commercial Court of Paris shall have sole jurisdiction notwithstanding any contrary clauses provided for on the order form or the customer's correspondence, regardless of the place of delivery, the method of payment accepted and even in the event of a warranty claim or multiple defendants.
Each order implies the customer's full acceptance of these General Conditions of Sale, which imply the customer's abandonment of their own general conditions of purchase.
The applicable law is French law.
